Kuwaiti Acquitted in Notorious Alcohol and Hashish Case

KUWAIT CITY, July 10: In a significant judicial development, a competent court issued a final ruling acquitting a citizen of all charges related to the possession and intended distribution of 96 bottles of imported alcoholic beverages and hashish allegedly intended for trafficking.

The ruling marks the conclusion of one of the most closely watched legal cases in recent months. The defense was led by Attorney Jarrah Al-Sharika, whose meticulous legal arguments were vital in securing the acquittal. The case has drawn attention due to the volume of contraband seized and the complexity of the legal procedures surrounding the arrest and investigation. However, Al-Sharika and his team successfully cited the procedural and evidentiary flaws in the case.

While the defense team chose not to disclose specific technical arguments — preserving them as part of the firm’s professional legal strategy– they emphasized that their arguments rested on solid legal foundations. Central to their case was the assertion that the evidence presented failed to meet the burden of proof required for a criminal conviction, particularly in cases involving serious charges such as drug and alcohol trafficking.

Commenting on the decision of the court, Al-Sharika asserted that “this ruling confirms the strength and prestige of the law when applied within its proper framework. It reinforces the fundamental legal principle that an accused person is innocent until proven guilty and reflects the integrity and impartiality of the judiciary when cases are approached with rational, methodical defenses. This outcome is another milestone in our firm’s ongoing efforts to uphold justice, protect individual rights, and strengthen the rule of law through unwavering professionalism.” The court’s decision to fully dismiss the charges and close the case was hailed by legal observers as a testament to the rigorous standards required for criminal convictions and the essential role of competent defense in maintaining the balance of justice.

KUWAIT CITY, Sept 20: The Court of Cassation on Thursday upheld the acquittal of a blogger residing outside Kuwait on charges of spreading false news. It also upheld the acquittal of a former National Assembly election candidate who expressed his dissatisfaction with the appointment of undersecretaries in ministries on social media.

Meanwhile, the Criminal Court rejected the request to release a Saudi woman accused of beating her maid to death in Sabah Al-Nasser, hence, the continuation of her detention pending trial. This court also postponed the hearing of the case of a citizen and others accused of insulting a segment of society, until Oct 1.

Meanwhile, the Court of Appeal on Thursday sentenced former MP Bader Al-Dahoum to one year in prison, suspended the execution of the sentence, and set bail at KD 5,000. The court also ordered Al-Dahoum to maintain good conduct for three years to avoid serving the sentence. Al-Dahoum was convicted of insulting Constitutional Court judges during a seminar. Also, the Court of First Instance ordered the Public Authority for the Disabled Affairs (PADA) to amend a citizen’s disability classification to “severe disability,” thus overturning a previous classification of medium disability.

The court based its decision on official medical reports proving the citizen’s deteriorating health condition requires permanent care. Lawyer Ali Matar Al-Wawan, who represented the citizen, emphasized that the ruling is a significant victory for the rights of persons with disabilities and affirms judicial oversight over administrative decisions impacting individuals’ basic rights. He said the court invalidated the prior classification due to its lack of a sound medical basis and contradiction with the Ministry of Health’s reports. Al-Wawan added that this ruling sets an important precedent, allowing all persons with disabilities to review their classifications and claim their full rights in cases of administrative errors or negligence.
